Terms of Service

These Terms govern your use of D8NYT ("D8NYT," "we," "us"), a date-planning web app for couples. By creating an account or using the service, you agree to these Terms. If you don't agree, don't use D8NYT.
1. Eligibility
You must be at least 18 years old to use D8NYT. By using it, you confirm that you are 18 or older and that the information you provide is accurate.
2. Your account
You're responsible for keeping your login secure and for activity under your account. Let us know promptly if you suspect unauthorized use. You may delete your account at any time from your account settings.
3. Partner linking and shared data
D8NYT is built for two. When you link with a partner, certain information becomes shared between you — including your name and photo and the couple's shared preferences, dates, and memories — and either partner can view and edit that shared content. Only the partner who set up a subscription can manage billing. Either partner can unlink at any time; your individual date history remains with your account.
4. Date suggestions are AI-generated
D8NYT uses AI to suggest date ideas, including specific venues, times, and costs. These are suggestions and may be inaccurate, out of date, or unavailable. Always verify details yourself — hours, reservations, prices, and whether a venue exists or is open — before you rely on them. We are not responsible for third-party venues, businesses, or events, or for your experience at them. Use common sense and take normal safety precautions when meeting or going out.
5. Subscriptions, billing, and cancellation
- Free first date. Each couple can plan their first date at no cost. Planning further dates requires an active subscription.
- Plans. Subscriptions are $4.99 per month or $49.99 per year (prices may change with notice). One subscription covers both partners.
- Payments and renewal. Payments are processed by Stripe and subscriptions renew automatically until cancelled. By subscribing you authorize recurring charges.
- Cancellation. You can cancel anytime from your subscription page; your plan stays active through the end of the paid period and does not renew after that.
- Refunds. Except where required by law, payments are non-refundable and we do not provide partial-period refunds.
- Promotions. Promo codes are subject to their own terms and may be changed or withdrawn.
6. Your content
You keep ownership of the content you add — notes, photos, preferences, and instructions. You grant us a limited license to store, display, and process that content solely to operate the service for you and your partner. You are responsible for your content and confirm you have the right to share it. Don't upload anything unlawful, infringing, or that you don't have permission to use.
7. Acceptable use
Don't misuse D8NYT. In particular, don't use it for anything unlawful; don't try to break, overload, scrape, or reverse-engineer the service; don't attempt to access other users' data; and don't upload malicious or harmful content. We may suspend or terminate accounts that violate these Terms or put the service or other users at risk.
8. Disclaimers
D8NYT is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that date suggestions will be accurate or suitable.
9. Limitation of liability
To the fullest extent permitted by law, D8NYT and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the service or from third-party venues or events. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or $50.
10. Indemnification
You agree to indemnify and hold harmless D8NYT and its operators from claims and expenses arising out of your misuse of the service, your content, or your violation of these Terms.
11. Termination
You may stop using D8NYT and delete your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the service.
12. Changes to these Terms
We may update these Terms as the product evolves. We'll update the "last updated" date and, for material changes, provide a more prominent notice. Continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Missouri.
